Seeking a Cancellation

Under certain circumstances, permanent and non-permanent residents may apply to a judge to adjust their deportation status to one lawfully admitted for permanent residence. There are a few requirements for this.


For permanent residents:

  • You have been a lawful permanent resident for at least five years.
  • You have resided in the United States for the last seven years.
  • You have not been convicted of an aggravated felony.


For non-permanent residents:

  • You have been physically present in the United States for at least 10 years.
  • You have shown good moral character during those years.
  • You have not been convicted of certain criminal offenses.
  • Your removal would create a hardship for a US citizen or a lawful permanent resident member of your family.

Petitioning an Asylum

You may be eligible for asylum in the United States if you have been harshly persecuted or may be persecuted in the country that you came from. That persecution, however, must be based on at least one of the following:

  • Race
  • Religion
  • Nationality
  • Political opinion
  • Membership in a social group

Requesting an Adjustment of Your Status

Adjusting your status in the United States is also known as applying for a green card. This can happen if you are present in the United States and wish to gain lawful, permanent residence.
