Administering A Loved One’s Estate

The death of a loved one is a difficult time. It’s made more difficult when the deceased family member or friend has not completely determined how their belongings will be distributed. Probate is the legal process to administer the deceased person’s estate.


If the deceased person had a last will and testament, the court determines if the will is valid. If the will is deemed valid, the court appoints a personal representative (executor) to handle the deceased person’s estate. The executor’s role is to execute the wishes of the deceased person by distributing their belongings. If debts are involved, the debts will be paid by the estate prior to distribution to the beneficiaries.


If the deceased person did not have a last will and testament, they die “intestate”. In this situation, the court determines how the deceased person’s belongings will be distributed according to Mississippi law.
